CONSTITUTION
ARTICLE I
NAME
1. This Society shall be known as the Society
of Commercial Seed
- Technologists, Inc. (SCST), a nonprofit
organization under the laws
- of the State of Wisconsin.
ARTICLE II
PURPOSES & POWERS
- The purpose of this Society shall be to
maintain and encourage the highest
- proficiency and professional standards among
its members: to promote seed
- technology research, teaching and extension
activities: to promote improvements
- in seed testing rules and procedures: to
promote domestic and international seed
- trade: to encourage cooperation between
regulatory and commercial entities.
- The Society shall have full power and
authority to govern
- itself, to determine the requirements for
membership, to
- maintain a Board of Examiners and conduct
examinations,
- to discipline or expel members who engage in
illegal or
- unethical practices or otherwise fail to
maintain the
- high standards of the Society. The Society shall have
- full power and authority to enforce its rules,
regulations
- and standards, and to engage in any activity
within the
- objectives and purposes of the Society as
adopted by the
- Members.
MEMBERSHIP
- The membership of this Society shall be
limited to eight classes of members:
- 1. Registered
Members who shall have the right to vote.
- 2. Certified
Members who shall have the right to vote.
- 3. Research Members who shall have the right to vote.
- 4. Associate
Members who shall be non-voting.
- 5. Registered
Members Inactive who shall be non-voting.
- 6. Certified
Members Inactive who shall be non-voting.
- 7. Research Members Inactive who shall be non-voting.
- 8. Honorary
Members who shall be non-voting.
- Requirements for membership and the procedures
to be
- followed by applicants shall be provided by
the By-Laws
- of this Society.
ARTICLE IV
FINANCES
- The Society shall be maintained as a
non-profit organization.
- Dues and assessments shall be provided for in
- the By-Laws.
The By-Laws shall provide a Use Fee for
- use of the Society Seal, Seal Number,
Insignia, Name of the Society, and
- title Registered Seed Technologist (RST), title Registered Genetic
Technologist (RGT)
- and titles
Certified Genetic Technologist (CGT), Certified Viability
Technologist (CVT),
- and Certified Purity Technologist (CPT) by Registered and
Certified
- members, respectively.
INTERNAL AFFAIRS OF THE
SOCIETY
- The Executive Board shall be responsible for
the business and internal
- affairs of the society. The Executive Board
- shall be composed of the President, Vice
President,
- Executive Director and five Directors elected
at large.
BY-LAWS
- The By-Laws of the Society shall prescribe the
qualifications
- for membership, the procedure for election of
officers, schedule
- of meetings, the Code of Ethics, the Privileged
Use of Seal, Seal
- Number, Insignia, title Registered Seed
Technologist, title
- Registered Genetic Technologist, the titles Certified Genetic Technologist,
- Certified Viability Technologist, and Certified Purity
Technologist,
- and Name of the Society and the duties of the
Executive Board, Officers and Committee
- Chairmen, and shall generally provide for the
operation of the
- Society in an orderly and democratic manner.
MEETINGS
- There shall be an Annual Meeting of the
Society for the
- purpose of transacting business and for the
general welfare
- of the Society. Written notice of the Annual Meeting
- shall be sent to all members ninety (90) days
prior thereto.
- Special meetings may be called by the
Executive Board
- or at the request of one-fifth (1/5) of the
Registered and Certified
- Members.
Written notice of special meetings shall be sent
- to all members not less than fourteen (14)
days prior thereto.

SECTION 1. MEMBERSHIP
- There shall be eight classes of membership in
the Society
- Of Commercial Seed Technologists as follows:
- 1. Registered
Members who shall be referred to as
- Registered Seed Technologist,
(RST) and Registered Genetic Technologist, (RGT).
- 2. Certified
Members who shall be referred to as a Certified Genetic Technologist, (CGT)
- Certified
Viability Technologist (CVT) and
Certified Purity Technologist (CPT)
- 3. Research Member.
- 4. Associate
Member.
- 5. Registered
Member Inactive, (RMI).
- 6. Certified
Member Inactive, (CMI).
- 7. Research Member Inactive.
- 8. Honorary
Member.
Registered Member
- The requirements and qualifications for
membership as a Registered
- Seed Technologist or Registered Genetic
Technologist shall be promulgated
- and adopted by the Executive Board. In order to maintain membership, the
Registered
- Member must be actively engaged in the
profession of seed testing by
- or for the seed industry or for an independent
service testing laboratory,
- which maintains not less than the minimum
prescribed equipment as
- determined by the Executive Board, and have fulfilled
said requirements
- and qualifications. Registered Members shall be entitled
to one (one) vote
- on all Society matters and the full privileges
of the Society including
- eligibility for any elective offices, and an
annual subscription
- to The Seed Technologist News. The Executive
- Board shall determine and define the
requirements and the qualifications
- for applicants for Registered Membership as to
education, experience, and training.
- All applicants for Registered Membership must
be approved unanimously by the
- Examination Committee. The Executive Board shall act as a
board of review
- if the Examination Committee cannot reach
unanimous approval.
Certified Member
- The requirements and qualifications for
membership as a Certified
- Genetic Technologist, Certified Viability Technologist, or
- Certified Purity Technologist shall be promulgated and
adopted by the
- Executive Board. In order to maintain membership, the
Certified
- Member must be actively engaged in the
profession of seed testing by
- or for the seed industry or for an independent
service testing laboratory,
- which maintains not less than the minimum
prescribed equipment as
- determined by the Executive Board, and have
fulfilled said requirements
- and qualifications. Certified Members shall be entitled to
one (1) vote
- on all Society matters, use of Society Name
and Insignia, and eligibility for any elective offices,
- and an annual subscription to The Seed
Technologist News. The Executive
- Board shall determine and define the
requirements and the qualifications
- for applicants for Certified Membership as to
education, experience, and training.
- All applicants for Certified Membership must
be approved unanimously by the
- Examination Committee. The Executive Board shall act as a
board of review
- if the Examination Committee cannot reach
unanimous approval.
Research Member
- The requirements and qualifications for
membership for a Research
- Member shall be promulgated and adopted by the
Executive Board.
- In order to maintain membership, the Research Member must be
- actively engaged in research, teaching and/or
extension in the area of
- Seed Science and Technology and have fulfilled
said requirements and
- qualifications. Research Members shall be entitled to one (1) vote on
- all Society matters, use of Society Name and
Insignia, and eligible for any
- elective offices, and an annual subscription
of The Seed
- Technologist News. The Executive Board shall determine
and define the requirements as to
- education, experience and training. All applicants for Research membership
- shall be approved unanimously by the
Examination Committee. The
Executive
- Board shall act as a board of review if the
Examination Committee cannot reach
- unanimous approval.
Associate Member
40. The requirements and qualifications for membership
as an
- Associate Member shall be promulgated and
adopted by the
- Executive Board. Associate Members shall include
persons
- aspiring to Registered or Certified Membership
or persons with an interest
- in seed technology. Associate members shall have no vote,
- shall not hold an elective office, and shall
not have use of the Seal,
- Seal Number, Insignia, Name of the Society, or
title Registered Seed
- Technologist.
They shall be entitled to all other privileges of the
- Society including annual subscriptions to The
Seed Technologist News.
- All applications for Associate Membership
shall be submitted to
- the Executive Director for processing.
Registered Member Inactive
- The requirements and qualifications for
membership as a Registered
- Member Inactive shall be promulgated and
adopted by the Executive
- Board.
Registered Members Inactive include Registered Members
- who are not presently employed in such
capacity, are on leave of absence,
- are retired, or have failed to meet Registered
Member maintenance
- requirements.
Registered Members Inactive shall have no vote, shall not
- be able to hold an elective office, and shall
not have use of the Seal,
- Seal number, Insignia, Name of the Society, or
title Registered
- Seed Technologist or title Registered Genetic
Technologist. Registered Members
Inactive shall
- return issued seal, if applicable, within
thirty (30) days of being served notice.
They shall
- be entitled to all other privileges of the
Society, including a complimentary
- subscription to the Seed Technologist News for
one (1) year, if requested. The
regular
- subscription rate will be charged after this
period.
Certified Member Inactive
- The requirements and qualifications for
membership as a Certified
- Member Inactive shall be promulgated and
adopted by the Executive
- Board.
Certified Members Inactive include Certified Members
- who are not presently employed in such
capacity, are on leave of absence,
- are retired, or have failed to meet Certified
Member maintenance
- requirements.
Certified Members Inactive shall have no vote, shall not
- be able to hold an elective office, and shall
not have use of the Insignia,
- Name of
the Society, or title Certified Genetic Technologist, Certified Viability
Technologist
- or Certified Purity
Technologist. They shall
- be entitled to all other privileges of the
Society, including a complimentary
- subscription to the Seed Technologist News for
one (1) year, if requested.
- The regular
subscription rate will be charged after this period.
Research Member Inactive
- The requirements and qualifications for
membership as a Research Member
- Inactive shall be promulgated and adopted by
the Executive Board.
- Research
Members Inactive include Research
Members who no
- Longer meet the qualifications for active
membership. Research Members
- Inactive shall have no vote, shall not be able
to hold elective office
, and shall not have use of the Name of
the Society or Insignia. They
- Shall be entitled to all other privileges of
the Society, including a complimentary
- Subscription to the Seed Technologist News for
one (1) year, if requested.
- The regular subscription rate will be charged
after this period.
Honorary Member
- Honorary Members are persons who have rendered
signal
- service in one or more of the fields of
activity of this Society.
- They shall be nominated for such membership by
a Registered or Certified
- Member subject to approval of the Membership
Committee and
- subsequently elected by two-thirds (2/3)
majority vote of returned
- of Registered and Certified Members. Honorary Members shall have no vote
nor hold
- an elective office. Not more than one (1) Honorary
Membership shall be
- awarded each fiscal year. As Honorary Member they shall receive
a
- complimentary one (1) year subscription to The
Seed Technologist News.
SECTION 2. APPLICATIONS
Registered Membership
- Applications for Registered Membership shall
be in writing to the Executive
- Director, who shall supply proper forms, and a
Privilege of Use Contract. The
- applicant shall return the signed forms and
signed Privilege of Use Contract to
- the Executive Director no later than March 1st
prior to the Annual Meeting.
- Submitted applications shall be accompanied with
an application fee payable
- to the Society of Commercial Seed
Technologists, Inc. Said fee
shall be established
- at the discretion of the Executive Board and
be refunded only if applicant is unable
- to meet requirements of the Society before
taking the examination.
Certified Membership
- Applications for Certified Membership shall be
in writing to the Executive
- Director, who shall supply proper forms, and a
Privilege of Use Contract. The
- applicant shall return the signed forms and
signed Privilege of Use Contract to
- the Executive Director no later than March 1st
prior to the Annual Meeting.
- Submitted applications shall be accompanied
with an application fee payable
- to the Society of Commercial Seed
Technologists, Inc. Said fee
shall be established
- at the discretion of the Executive Board and

Associate Membership
- Applications for Associate Membership shall be

- Director, who shall supply proper forms. The applicant shall return the signed
- application to the Executive Director.
Registered Member Inactive Reinstatement
- Applications by a Registered Member Inactive
for reinstatement to Registered
- Seed Technologist or Registered Genetic Technologist
shall be submitted to the Executive
- Director in writing, and shall become effective only upon
verification of re-employment status,
- laboratory equipment/reference material
inspection if applicable, proof of compliance for the
- continuing education requirement, payment of
all unpaid dues and assessments during any fiscal
- year while a Registered Seed Technologist or
Registered Genetic Technologist, receipt of signed
- Privilege of Use Contract, and unanimous
approval by the Examination Committee.
The
- Executive Board will act as a board of review
if the Examination Committee cannot reach
- unanimous approval. Approved applicants are responsible
for dues for the fiscal year for
- which they are reinstated.
Certified Member Inactive Reinstatement
- Applications by a Certified Member Inactive
for reinstatement to Certified
- Genetic Technologist, Certified Viability Technologist, or Certified Purity
Technologist
- shall be submitted to the Executive Director
in writing, and shall
- become effective only upon verification of
re-employment status, laboratory equipment/
- reference material inspection if applicable,
proof of compliance for the continuing
- education requirement, payment of all unpaid
dues and assessments during any fiscal year
- while a Certified Member, receipt of signed
Privilege of Use Contract,
- and unanimous approval by the Examination
Committee. The Executive Board
- will act as a board of review if the
Examination Committee cannot reach unanimous
- approval.
Approved applicants are responsible for dues for the fiscal year
for
- which they are reinstated.
Research Member Inactive Reinstatement
- Applications by a Research Member Inactive for reinstatement to Research Member
- shall be submitted to the Executive Director in
writing, and shall be effective only
- upon verification of meeting Research Member qualifications, receipt of signed
Privilege of
- Use Contract, payment of unpaid dues and
assessments during any fiscal year while a
- Research
Member, and unanimous approval by the Examination Committee. The Executive
- Board will act as a board of review if the
Examination Committee cannot reach unanimous
- approval.
SECTION 3.
EXAMINATIONS FOR REGISTERED AND CERTIFIED MEMBERSHIP
- All examinations for Registered or Certified
Membership shall be conducted by the Examination
- Committee as directed by the Executive Board
members. Examinations of
- applicants shall be conducted at times and
places as directed by the Executive Board.
SECTION 4.
CERTIFICATES OF MEMBERSHIP
- Certificates of membership shall be awarded by
the Society
- and presented to each Registered Member,
Certified Member, Research Member,
- and Honorary Member.
Registered Member
- Dues for Registered Members shall be determined
annually by the
- Executive Board, based on projected
requirements as recommended by
- the Executive Director..
- Dues for the upcoming year shall be paid
annually, on or before May first.
- The fiscal year of the Society shall be from
May first to April thirtieth
- Full payment of dues and assessments is
required of any individual who is a
- Registered Member during any part of a fiscal
year of this Society.
- A special assessment for Registered Members
not to exceed one-half (1/2) of the
- established annual dues per member in any one
fiscal year, may be levied upon
- recommendation of the Executive Board, should
necessity or emergency exist.
Certified Member
- Dues for Certified Members shall be determined
annually by the
- Executive Board, based on projected
requirements as recommended by
- the Executive Director. Dues for the upcoming
year shall be paid annually,
- on or
before May first. The fiscal year of the Society shall be from May first
to April thirtieth.
- Full payment of dues and assessments is
required of any individual who is a
- Certified Member during any part of a fiscal
year of this Society.
- A special assessment for Certified Members not
to exceed one-half (1/2) of the
- established annual dues per member in any one
fiscal year, may be levied upon
- recommendation of the Executive Board, should
necessity or emergency exist.
Research Member
- Dues for Research Members shall be determined annually by the
Executive Board, based

Executive Director. Dues for the
upcoming
- year shall be paid annually on or before May
first. The fiscal year of the
Society shall be
- from May first to April thirtieth. Full payment of dues and assessments
is required of
- any individual who is a Research Member during any part of a fiscal year of
this Society.
- A special assessment for Research Members not to exceed one-half (1/2) of the
- established annual dues per member in any one
fiscal year, may be levied upon
- recommendation of the Executive Board, should
necessity or emergency exist.
Associate Member
- Dues for Associate Members shall be determined
annually by the Executive Board, based
- on projected requirements as recommended by
the Executive Director. Dues for
the
- upcoming year shall be paid annually, on or
before May first. The fiscal year
of the
- Society shall be from May first to April
thirtieth. Initial Associate dues
are prorated to
- the nearest quarter upon activation.
Registered, Certified and Research Members Inactive
- Registered, Certified and Research Members Inactive shall pay no dues or
assessments.
Honorary Member
- Honorary Members shall pay no dues or
assessments.
SECTION 6.
MAINTENANCE OF MEMBERSHIP
- (A)
Resignation: Resignations
shall be submitted in writing to the
- Executive Director. All indebtedness, and dues for the
current fiscal year
- shall be paid at the time the resignation is
submitted
- (B)
Non-payment of dues:
Failure of any Registered, Certified or Research member
- to pay dues or special assessments owing to
the Society for a period of
- sixty (60) days from and after the date of the
first item of indebtedness, shall
- be grounds for dismissal from membership. The Executive Director shall give
- written notice to said delinquent member that
said dues or assessments must
- be fully paid within thirty (30) days from
date of indebtedness. If the
delinquency
- exists after sixty (60) days, the member shall
be dropped from membership and
- shall lose all rights and privileges and must
immediately discontinue use of
- the Seal, Seal Number, Insignia, title
Registered Seed Technologist, title Registered Genetic
- Technologist, title Certified Genetic
Technologist, title Certified Viability Technologist,
- and title Certified Purity Technologist and
name of the Society as applicable.
- (C)
Misconduct, unethical practices, etc: Membership in the Society
- of Commercial Seed Technologists is a
privilege and not a legal right.
- Any member of the Society may be suspended or
expelled from membership
- and deprived of the privileges appertaining
thereto for any illegal or unethical
- action, for any conduct which might adversely
reflect upon the reputation and high
- standing of the Society, or for failure to
comply with the principles and purposes
- of the Society in accordance with this
Constitution and By-Laws.
- Complaints against a member shall be processed
as follows:
- 1) The
complaint shall be signed and submitted in writing, to the
-
Executive Director.
-
It shall describe in detail the conduct of the offending member
and
-
shall be supported with
documentary evidence, where applicable.
- 2) Within
ten (10) days of receipt of said complaint, the Executive Director
shall present same to the Executive Board.
- 3) The
Executive Board shall either investigate the complaint, or direct
-
the President to appoint a Grievance Committee, as provided for
in Article VI,
-
Section 1 of these By-Laws, to investigate the charges as
-
expeditiously as possible.
- 4) The
reports of the Grievance Committee shall then be re-examined
-
by the Executive Board. If
the Executive Board finds reasonable
-
cause to believe that the charges should be further investigated,
then a
-
copy of the complaint shall thereupon be submitted to the member
or
-
members so charged.
- 5) The
Member and employer will fully comply and cooperate
- with the Grievance
Committee and Executive Board in their investigation.
- 6) Within
sixty (60) days the member being charged may appear before the
- Executive Board and may
submit evidence and explanation in defense of
- the complaint. The Executive Board may thereupon
request further
- investigation if deemed
necessary or may dispose of the complaint as follows:
- a) Dismiss the complaint and make publicly available
all documentation
- relevant to
the investigation if so requested by complainant;
- b) Suspend the offending member or members and
immediately recall
- the Seal
and prohibit use of the Seal, Seal Number, Insignia,
- title Registered
Seed Technologist, title Registered Genetic Technologist, title
- Certified
Genetic Technologist and Name of the Society
- for a
period of not more than one (1) year, all dues to be paid
- during the period
of suspension;
- c) Expel the offending member or members and
immediately recall the
- Seal and
prohibit further use of the Seal, Seal Number, Insignia, title
- Registered
Seed Technologist, and Name of the Society, and void all
- contracts
and agreements pertaining thereto;
- d) Take such other action as the Executive Board may
deem advisable.
- The
Executive Director shall notify the member charged as to final
disposition of the
- charges in writing. The Registered or Certified Member and
Employer will abide by whatever
- actions deemed appropriate according to the
Constitution and By-Laws of said Society.
- (D)
Continuing Education: To
maintain Registered or Certified Membership status,
- each member shall meet one of the following
Continuing Education
- requirements every three (3) years.
- 1) Attend a minimum of three (3) full days at
the Annual Meeting of the Society,
- which shall include attendance at the SCST
business meeting,
- Registered or Certified Members present at the meeting but not in attendance
during
- Roll Call are responsible for having their
name recorded by the Executive Director, or
- 2) Attain five (5) points for attendance at
workshops or seed schools directly related
- to seed testing that comprise a “hands-on”
type program and have been approved
- prior to attendance by the Executive Director,
or
- 3) attend individualized seed technology
training that receives prior approval by the Executive Director. Points are credited on the basis
- of one (1) point for every three (3) hours,
maximum two (20 points per day.
- A certificate of attendance must be submitted
to the Executive Director to
- receive proper point credits. College credits from approved seed
related courses would be
- acceptable for up to half (1/2) of required points
based on three points for each semester hour
- or two (2) points for each quarter hour.
- Any active member failing to meet these
requirements
- within two (2) years will receive written
notice from the Executive Director that
- Registered
or Certified membership maintenance requirements must be met within
the next
- twelve (12) months.
- Failure to meet these requirements shall cause
a Registered or Certified
- Member to become a Registered or Certified
Member Inactive and lose Registered or Certified
- Member’s rights and privileges. Upon receiving notice, the Registered
Member Inactive shall return
- the Seal, if applicable, within thirty (30)
days to the Executive Director.
- (E)
Compliance and Liability:
Each member of the Society agrees, by joining and maintaining
- membership in the Society, to comply with and
to be bound by the foregoing procedures
- and further agrees that there shall be no
liability on the part of the Society or any
- members of the Society for any damages which
might accrue to a member by reason of
- their being charged, investigated or expelled
as provided by Section 6 hereof.
SECTION 7.
RELOCATION OF MEMBER
- In the event of change in employment or
relocation, such
- member shall immediately notify the Executive
Director
- of such change in status, and provide evidence
of
- compliance with ARTICLE 1, of By-Laws
hereof. In the case of change of
- employment a new “Privilege of Use” Contract
shall be signed with the new
- employer, and returned to the Executive

SECTION
1. OFFICERS
- The elective officers of this Society shall
consist of a President, a
- Vice President, Vice
President, and five Directors, four elected at large and
- one director elected from the Registered and Certified Genetic
Technologist members.
- There shall be an Executive Board which shall
comprise the
- above officers and the Executive Director.
- Elected officers shall serve
- without compensation except for personal
expense and service in performance
- of official duties authorized by a majority of
the Executive Board.
- The Executive Director is a non-voting
position, selected by a search committee appointed by the elected
officers,
- whose duties and compensation are determined by
a majority of the elected officers of the Society.
SECTION 2. ELECTIONS
- Elections shall be by electronic message,
facsimile or mail ballot and held biannually. No more than two (2) Candidates for
- each office of President, Vice President.
- No more than six (6) candidates for Director
at large offices shall be
- nominated by a Nominating Committee.
- Nominations shall be submitted forty-five (45)
days prior to the Annual Meeting date,
- when the Executive Director shall furnish each
voting member with one (1) official ballot,
- which shall be marked and returned to the
Executive Director
- not less than ten (10)
- days prior to said date. Said ballot shall be tallied by the
Executive Director
- and a plurality shall elect.
SECTION
3. TERMS OF OFFICE
- The Elective offices shall serve for a term of
two (2) years, or until their successors are
- elected.
In no case shall the President serve more than two (2)
consecutive terms in such
- office.
Should an elective office vacancy occur during the term of duty,
such vacancy
- shall be filled for the unexpired term as
provided in Article II, Section 4 of the By-Laws.
SECTION
4. SUCCESSION OF OFFICERS
- The rotation of elective offices shall be from
Vice President to President
- Should the office of President be vacated
during the two (2) year term, the Vice
- President shall assume the office and title
for the unexpired term. In the
event
- of vacancy in the office of Vice President, a
Director at large
- shall be elected by a majority vote of the
remaining members
- of the Executive Board to serve the remainder of the unexpired term, until elections
are held in accordance hereto.
- Any vacancy occurring in the Director at large
- offices may be filled by majority vote of the
remaining members
- of the Executive Board until the next
elections.
SECTION 1. MEETINGS
- Annual and special meetings shall be held in
accordance with
- Article VII of the Constitution.
SECTION
2. QUORUM
- A quorum for the Annual or special meetings
shall be a majority
- of the voting members in attendance at the
time of said meetings.

SECTION 1.
DUTIES OF EXECUTIVE BOARD
- The Executive Board shall be responsible for
conducting business and internal affairs
- of the Society, including but in no way
limited by the following:
- Shall be responsible for all Society funds and
their expenditures;
- Shall establish or repeal such dues and
assessments as are necessary to the
- Society welfare;
- Shall have full authority to regulate
consignment and use of the Seal
- Seal Number, Insignia, and name of the
Society;
- Shall determine and define the requirements
and the qualifications to be a
- Registered or Certified Member;
- Shall direct the Examination Committee and so
prescribe forms, grades, procedures
- and rules, and shall direct the conduct of said
examinations;
- Shall award Certificates of Membership to each
Registered Member, Certified Member, Research
- Member and Honorary Member;
- Shall have power and authority to take
disciplinary action as delegated in Article I,
- Section 6, of these By-Laws; and
- Shall employ legal counsel when applicable.
- A two-thirds (2/3) majority shall constitute a
quorum of the Executive Board.
The Executive
- Board shall meet a minimum of twice yearly.
SECTION 2.
DUTIES OF THE PRESIDENT
- The President shall preside at all Society and
Executive Board meetings;
- Shall appoint all committees and make replacements
as may be necessary,
- except as otherwise provided;
- Shall see that programs decided upon by the
Executive Board are carried out
- by the Vice President
s, the Executive
Director, Directors at large, and Committees;
- Shall appoint an Auditing Committee which
shall make an annual audit of the books
- of the Executive Director; and
- Shall be an ex-officio member of all
Committees, with the exception of the Nominating
- Committee.
SECTION 3.
DUTIES OF THE VICE PRESIDENT
- The Vice President shall assume such duties as
may be assigned by the President;
- Shall preside at Society and Executive Board
meetings in the absence of the President; and
- shall be Chairman of the Examination Committee.
SECTION 4.
DUTIES OF THE DIRECTORS AT LARGE
- The Directors at large shall assume such
duties as may be assigned by the President;
- Shall develop workshops and/or symposiums for
the Annual Meetings;
- Shall review and recommend revisions of the
Society’s Constitution and By-Laws; and one
- Shall serve as parliamentarian at all Annual,
Special, and Executive Meetings of the Society.
- One shall be responsible for all activities of
the Research Committee;
- Shall serve as liaison to the AOSA research
committee; and
- Shall recommend proposals for seed research
funding to the Executive Board.
- One shall serve as SCST Program Chairman for
the Annual Convention: and
- One shall serve as member of the Ethics Committee.
- One shall serve as a member on the board of directors of the
International
- Society of Seed Technologists, Inc.
SECTION 5.
DUTIES OF THE EXECUTIVE DIRECTOR

Shall perform all membership-related duties as set forth in Article I, Section 6
and 7 of the

By-Laws. Shall be
responsible for all activities of the Membership Committee to include

providing membership materials when requested,
maintain and update membership materials,

receive and process all applications for membership,

re-examination applicants, and shall receive and

Registered or Certified Member candidates. Shall assist and prepare materials for the

Shall perform treasurer
duties by managing financial needs of SCST including preparing

Financial status reports as needed, budgets, and
quarterly reports. Shall collect all

dues and assessments, pay all expenditures, make and

as may be necessary thereto;

periodical electronic newsletter to keep

membership updated on Society activities.

Shall perform administrative
duties for the Society and handle business affairs to manage daily

operation of the society, act as a liaison between
related professional organizations, expand

relationships, and increase visibility of the
Society.

Shall represent SCST at seed industry and affiliate
organization meetings as directed by the

Executive Board, coordinate committee chair
activities, coordinate schedule needs for

- Standing committees shall be created for the
purposes and functions defined as:
- MEMBERSHIP
DEVELOPMENT AND PUBLIC RELATIONS
- This committee shall consist of the Chair and
the remaining members selected by the Chair
- by and with the consent of the President.
- Duties
of this committee shall be:
- A) To increase and promote
all Society membership categories;
- B) To promote and publicize
this Society and its activities to the Seed Trade
- and the general public;
- C) To send Society news
releases, including election of officers, to industry
- related periodicals.
- RESEARCH
- This committee shall consist of the Research Director as appointed by the President,
- and the remaining members selected by the Chair and with the consent
of the President.
- The duties of this
committee shall be:
- A) To conduct such
research as the Committee or the Executive
- Board or the Society shall
deem advisable;
- C) To accept and review
proposals for research studies.
- D) Promote and publicize Research Activities for the benefit of SCST and its
- membership.
- The Research Chairman shall serve as liaison to the
Association of
- Official Seed Analysts Research Committee.
- LEGISLATIVE
- This committee shall consist of (1) or two (2)
members,
- the Chairman appointed by the President and
- the remaining members selected by the
Chairman, by and with
- the
consent of the President.
- The duties of this
Committee shall be:
- A) To keep the Society
advised of new and/or pending
- legislation, and any regulations
issued by State or
- Federal agencies;
- B) To cooperate with the
Legislative Committee of the American
- Seed Trade Association on any
action to be taken in
- legislative matters, and report to
the Executive Board
- and/or the Society
for consideration and action.
- NEWSLETTER
- This Committee shall consist of five (5) to
nine (9) members, the
- Chairman appointed by the President, and the
remaining members
- selected by the Chairman, by and with the
consent of the President.
- The duties of this
committee shall be:
- A) To edit and publish the
Society periodical “Seed Technologist News” under the
- direction of the Chairman who
shall be designated as the “Editor” thereof.
- To distribute copies of each
issue to all members and to such
- organizations or individuals as
may be recommended and approved
- by the Executive Board, and to
such subscribers of record submitted by
- the Executive Director. Subscription rates shall be based on
- costs of publication
and distribution, and shall be established as needed by the
- Executive Board;
- B) To edit and publish all
publications of the Society.
- HISTORIAN
- The Historian of the Society shall be
appointed by the President.
- The
duties of the Historian shall be:
- A) To and keep such
records as are pertinent to the
- history of the Society;
- B) To procure facts and
figures from the Executive Director, the
- Executive Board, the Membership
Committee, and individual members pertinent
- C) To present the
necrology report at the Annual Meeting;
- D) To keep all records
current;
- E) To transfer to a
successor all records that will aid the
- incoming Historian to continue the
history of the Society in an interrupted manner.
- ETHICS
- This committee shall consist of a Chairman,
five (5) regular members,
- and one of the Directors at large. The
Director to serve as Liaison with the Executive Board.
- Regular members shall serve four (4) years
with no more than one half (1/2)
- the committee rotating off every two (2)
years. The Chairman shall be
appointed by the President
- from the existing committee members, and
remaining members selected by the Chairman,
- by and with the consent of the President.
- The
duties of this committee shall be:
- A)
To address ethical questions from the membership;
- B) To develop, encourage
and promote among the members firmer business
- unity which will improve and
perfect a standard of business integrity and
- ethics in transactions between the
members, between members and the industry,
- and with the general public;
- C) To encourage that in all
testing and advertisements of testing, the members of
- Society shall practice entire good
faith, shall give full and truthful representation
- of the quality and descriptions of
seeds sold or offered for sale, and in their trade
- relations shall studiously avoid
the use of terms or expressions that are
- false or misleading;
- D) To accept ethical
inquiries and investigate such inquiries to recommend a course of
- action to be taken and to report
such findings to the Executive Board.
- E) To keep all matters
brought before the committee confidential
- between committee and Executive
Board members.
- NOMINATING
- This committee shall consist of three (3)
members,
- the
Chairman appointed by the President, and remaining members
- selected by the chairman, by and with
the consent of the President.

The duties of this committee shall be:
- A) To notify all voting
Members that nomination for elective officers
- and/or Honorary Member are in
order;
- B)
To use said nominations as a guide to selection of candidates for said
elections;
- C) To establish the
willingness and ability of each candidate to serve
- if elected to office;
- D) To submit slate of
candidates to the Executive Director forty-five (45)
- days prior to Annual Convention.
- RULES
- This committee shall consist of three (3) or
four (4) members, the Chairman
- appointed by the President, and
remaining members selected by the Chairman,
- by and
with the consent of the President.
- The duties of this
committee shall be:
- A) To review existing
rules for inconsistencies, problems and omissions;
- B) To inform membership of
rules proposals and solicit responses;
- C) To review rule change
proposals for inconsistencies, problems, and omissions;
- D) To inform ASTA, AOCSA,
AASCO and other pertinent industry related
- organizations about proposed rule
changes and to solicit responses from same;
- E) To inform membership of
any areas of concern.
- The
chairman shall act as the Society of Commercial Seed Technologists
representative to the
- AOSA
Rules Committee.
- EXAMINATION
- This
committee shall consist of a the Vice President as Chairman, and the
- RST
Board of Examiners and the RGT Board of Examiners. Each Board of Examiners will
- consist
of a chairman and seven (7)
members.
- The duties of this
committee shall be:
i.
To review and evaluate all applications for
membership as provided by the executive director;
ii.
To recommend such courses or study for each RST, RGT
or CGT applicant;
iii.
To maintain the highest level of security with examination
materials;
iv.
To maintain and update a library of examination
questions and sample materials;
v.
To arrange places and times of examinations;
vi.
To proctor and grade examinations in a professional
manner;
vii.
Report the outcome of examinations to the Executive
Board and membership;
- REFEREE
AND METHOD VALIDATION
- This
committee shall consist of the
chairman appointed by the President
- and
the remaining members selected by the chairman by and with the consent
of the President.
- The duties of this committee
shall be:
- A) To conduct referee tests to promote greater
uniformity
- among members and to report findings of such
tests,
- one from
each SCST region;
- B) Provide statistical support to other
Committees
- C) Review
new test methods using statistics.
- GENETIC
TECHNOLOGY
- This
committee shall consist of no less than three (3) members.
- The
Chairman appointed by the president, and the remaining members selected
by the
-
Chairman with the consent of the President.
- The duties of this
committee shall be:

A) Review genetic testing methods used for testing seeds.

B) Work with the RGT board of examiners and working groups to
improve awareness of
- new trends and
provide expertise in genetic technology as it relates to seed testing.
SECTION
10. SPECIAL COMMITTEES
- Special committees and their chairman may be
appointed by the President when
- necessary and advisable. The chairman of special committees
shall report at the
- Annual Meeting.
SECTION 11. SPECIAL REPRESENTATIVES
- Special representatives to organizations, or
committees of organizations outside
- the Society shall be appointed by the
President when requested. Special
- representatives shall report at the Annual
Meeting.
SECTION 12. EXPENSES
- Functional expenses of committee operation
and/or individual personal expense in
- performance of official or committee duties
when authorized by a majority of the
- Executive Board, shall become an obligation of
the Society.

stars representing the 13 charter members.
- C) Seal = A signet of the SCST having a raised emblem
or stamp an impression on
- a
receptive substance or a digital representation of the seal.
- D) Seal number = Registration number of the
Registered Seed Technologist (RST)
- or
Registered Genetic Technologist (RGT).
- When more
than one RST or RGT is employed at the same location, each may
- be
registered under the same Seal number.
- E) Registered Seed Technologist = Title conferred by
the SCST upon an
- individual;
who continues to be a full member as defined by the SCST.
- F) Registered Genetic Technologist = Title conferred
by the SCST upon an
- individual;
who continues to be a full member as defined by the SCST.
- PURPOSE:
- I. Name and Insignia = Identifies a professional
organization comprised of seed
- technologists,
and distinguishes that organization from others of similar
- name
and/or purpose. Appropriate uses
of the name and insignia include:
- A. To
identify official correspondence and publications of the SCST.
- B. To
identify members of the SCST.
- C. To
promote the organization and its members to the agricultural
- community.
- II. Seal = To apply the insignia on a report of
analysis.
This validates the signer as a member of
the SCST. It also validates the report
as
an original document. The use of the seal is optional.
- III. Seal Number = To be used by
the Registered Seed Technologist or Registered
- Genetic
Technologist in conjunction with:
- A.
Signature and titles of Registered Seed Technologist and Registered
Genetic
-
Technologist on a report of analysis.
- B. Use of
Society name, insignia, and/or titles of Registered Seed Technologist
- and Registered
Genetic Technologist in professional correspondence.
- C. Use of
Society name, insignia, and/or titles of Registered Seed Technologist
- and
Registered Genetic Technologist in promotional publications.
- IV. Registered Seed Technologist and Registered Genetic
Technologist = Indicates
- the
professional experience and training of the individual with which it is

associated. Appropriate
uses of these titles include:
- A. In
conjunction with the name and signature of the analyst on a
- report of
analysis.
- B. In
conjunction with the name of the analyst in the promotion of the
- individual
and/or their business.
- The Privilege of Use Contract for the Seal,
Seal Number, Insignia, title Registered Seed
- Technologist, title Registered Genetic
Technologist and Name of the Society is limited to
- Registered Members and shall be governed by
the Executive Board. The
established “Use Fee”
- (cost plus handling) shall be collected by the
Executive Director for this privilege.
The Privilege
- of Use Contract for the Certified Genetic
Technologists and
- Research
Members is limited to the use of Insignia and Name of the Society, and
shall be
- governed by the Executive Board. The Executive Director
- shall provide proper “contract”
- forms, in duplicate, which shall specifically
designate conditions of use and those governing
- surrender. This contract
for “Privilege of Use” shall be
- compulsory and binding on all new members and shall be
retroactive upon present members now
- exercising the privilege
- without benefit of contract. Full compliance herewith shall be done
by all members
- within sixty (60) days following adoption of
these By-Laws and failure to so comply shall be
- grounds for action as provided in ARTICLE I,
Section 6, hereof. The Seal shall
be returned to
- the Executive Director, within thirty (30)
days, in the event of death or becoming
- Registered Member Inactive and Privilege of
Use shall be voided therewith.
- Transfer or relocation of consignee of Seal
shall be done as provided in ARTICLE I,

1. GRIEVANCES
- Should the occasion arise, a Committee on Grievances
may be adopted to investigate
- complaints or charges of non-compliance with
these By-Laws or unethical practice by
- Member.
This Committee shall be appointed by the President, shall consist
of five (5)
- members:
The President, the Executive Director and three voting
members residing
- within the region where such grievance has
occurred. Should a seed firm be
involved
- in such investigation, the President of the
American Seed Trade Association may be
- called upon to appoint a member of that Association
to serve in an advisory capacity with this
- committee.
The personnel of this committee shall be known only to the
President and
- the Executive Director.
SECTION
2. DUTIES & PROCEDURES
- The Committee on Grievances, upon being
appointed and appraised of such alleged
- unethical conduct, shall be empowered with
authority to make inquiry of the principals
- involved, and to conduct a complete
investigation. All evidence shall
be submitted in
- writing to the Executive Board, which shall
then proceed as provided by
- ARTICLE 1, Section 6, Subsection 3 of the
By-Laws.
SECTION
1. AUTHORITY
- The rules contained in “Robert’s Rules of
Order, Revised” shall govern the Society in
- all cases in which they are not inconsistent
with the By-Laws of the Society.

SECTION
1. AMENDMENTS
- Amendments to the Constitution and/or By-Laws
or repeal thereof, shall be made by
- two-thirds (2/3) majority of affirmative
electronic message, facsimile or mail ballots received by the Executive
Director
- within thirty (30) days after submission to
all voting Members.
SECTION 1.
INDEBTEDNESS
- The Society is a non-profit organization. The
Executive Board shall authorize and
- approve all expenditures. No member or officer shall have
authority to obligate the
- Society for any amount beyond the existing assets
of the Society. Private property
of members or
- their employers shall not be subject to the
payment of the debts of the Society be subject to
- assessment other than for membership fees and
special assessments as may be provided by
- the By-Laws.
SECTION 1.
TESTING PROCEDURES
- When conducting service tests or any tests
which shall be used for the marketing and labeling
- of seed, Registered and Certified Members are required
to follow official rules as established by
- the
Association of Official Seed Analysts, the Federal Seed Act,
Agriculture Canada, or the
- International Seed Testing Association, or
specific rules pertaining to the country where seed is to
- be offered for sale, and to report test
results according to the appropriate recommended
- procedures, including, a statement of which
rules were used.
SECTION 2.
REPORTING SPECIAL TESTS
- Appropriate comments shall be included on any
report of analysis when reporting the results of
- testing procedures not included in officially
recognized rules for testing seeds as stated in
- Section 1.
These special tests may be reported on the same Reports of
analysis used when
- reporting tests by officially recognized ruled
for testing seeds. The Society
name, Insignia, Seal,
- Seal Number and title Registered Seed
Technologist or Registered Genetic Technologist may be
- used on said reports.

Registered and Certified Member agrees to be guided by the highest standards
of

ethics, personal honor, and professional conduct.
SECTION
2. RELATION OF THE REGISTERED AND CERTIFIED
MEMBERS TO THE PUBLIC
1. 1) A
member shall avoid and discourage sensational, exaggerated, and/or
-
unwarranted statements that would reflect negatively upon the
Society and/or the
-
Profession.
3. 2) A
member shall not knowingly permit the publication of his analysis or other
- documents for any unethical
or illegal purposes.
- 3) A
member shall not give professional opinions or make a recommendation
-
without being
- thoroughly informed. The degree of completeness of the
information upon which such
- recommendation or opinion
is based, shall be made clear.
- 4) A
member may publish dignified business, professional, or announcement
-
cards, but shall not advertise his work or accomplishments in a
self-laudatory,
-
exaggerated, or unduly conspicuous manner.
- 5) A member shall not issue a
false statement or false information even though
-
directed to do so by employer or client.
SECTION
3. RESPONSIBILITIES OF THE REGISTERED AND CERTIFIED
MEMBER TO EMPLOYER AND CLIENT
- 1) A
member shall protect, to the fullest extent possible, the interest of
his

2004 (1) Procedures for Conducting Business at the Annual
Meeting.
The SCST executive board formally adopts as policy
the Procedures for Conducting
Business at the Annual Meeting.
According to these procedures old and new business agenda items must
be presented or discussed during the long range planning session. Motions or
resolutions not discussed or presented at the long range planning session
during the current annual meeting cannot be proposed during the SCST business
meeting and will not be recognized on the floor for discussion or voting. The
Procedures for Conducting Business at the Annual Meeting are available from
the SCST website for members to review.

“grand fathered” as Registered Seed
Technologists
A CSAAC Senior Analysts may apply to become
an RST if they have
successfully passed the germination and
purity portions of the CSAAC examinations.
An application must be filed with the Executive Director, a Privilege
of Use Contract signed and membership dues paid before a Senior Analyst
becomes a RST.
(2) Executive Board
reimbursement for travel expenses.
Executive board members can request $300
per year reimbursement for travel expenses to board meetings.
(3) The
Seed Technologist Newsletter shall be published on CD starting in September
2002.

Enrollment for AOSA, Certified Seed Analysts to become
Registered Seed Technologists in the SCST.
An
AOSA, Certified Seed Analyst may apply to become a RST in the SCST, when they
have successfully passed the Germination and Purity portions of the CSA
examinations. An application must be
filed and approved, Contract signed and dues are to be paid before becoming a
Registered member in the SCST.

becoming a Registered Member Inactive (RMI).
Before a new Registered Member can go to a RMI status, one year of paid
dues and participation are required.
March, 1996 (1) Continuing Education Requirements:
Continuing
education programs must be approved by the Membership

Inactive have been defined. Five (5)
points of continuing education are required for each year that the Registered
Seed Technologist has been RMI, up to a maximum of twenty-five (25)
points. RMIs that have been actively
engaged in seed testing are required to obtain one-half (1/2) the amount or
two and one-half (2 ½) points per year up to a maximum of twelve (12)
points. In both cases, one-half (1/2)
the amount of points required to reinstate may be obtained from college
courses.
March, 1996 (3) A Registered Seed Technologist
employed by an official laboratory.
A
Registered Seed Technologist employed by a designated official
Laboratory may perform their assigned duties and if their job

dictates, execute regulatory responsibilities.

contracting service testing for an

laboratory.
A
Registered Seed Technologist may perform seed testing for
Government
agencies but must not:

Advertise as being an official (state or federal)
laboratory.

Must not be involved in any regulatory work,
such as, but not limited to issuing stop-sales, etc.
·
The work shall be conducted in the facilities
of said RST and the analysis should be reported as being conducted by a RST,
member of the SCST, and not as an official laboratory.
March, 1996 (5) The
interpretation of Article 1 of the By-Laws, lines 13 and 14
“by
or for the seed industry” does not limit the use of the seal to
businesses
actually involved in seed production, seed conditioning, or
marketing
of seed, and that Article I, Section 1 of the By-Laws, line 14
“independent
service testing laboratory” does not limit the condition of ownership except
as stated in Article I, Section 1, lines 14, 15, 16, and 17.
March,
1994 (1) Transferring information from one analyst’s report
of analysis to another analyst’s report.
This
pertains to situations where one analyst/lab has issued a
Report
of analysis for the partial or total analysis of a seed lot. A subsequent analysis by a different
analyst/lab updates or completes a portion of the original analysis. A report of analysis is required to
complete the sale of that seed lot. In
this situation the second analyst should issue a report of analysis only on
those tests actually done. Copies of
both documents should be used to substantiate seed quality of the sales
transaction.
There
exist situations, however, where one analyst/lab may subcontract certain
tests to another lab. If the first
analyst wishes to include test results from outside testing on his report of
analysis, prior permission must be obtained from the second analyst/lab. The Executive Board suggests permission be
obtained in writing. Failure to obtain
appropriate authorization in this matter could result in litigation due to
plagiarism. An RST found guilty of
plagiarism by the Committee on Grievances (Article VI, Section1) will be
dismissed from active membership. An
RST bears the responsibility for the accuracy of all test information on a
Report of analysis he/she has signed.
March, 1994 (2) When a position of employment has been vacated by one
RST
and replaced by another RST.
This
pertains to seed company owned and operated labs where test results are kept in
card files or stored in computer files and reports of analysis have not been
issued routinely at the conclusion of testing each lot. All test information is the property of the
seed company. The new RST employee may
use test data from the previous RST employee’s work for issuing reports of
analysis if the following conditions have
been
met.
a.
The seed lot in question has not been altered (i.e.,
reconditioned or rebagged) since the initial testing was done.
b.
The germination test data is in compliance with
Federal Seed Act requirements.
c.
The previous tests were conducted by or under the
supervision of an RST.
If
the current RST feels the previous test results may not be accurate for
whatever reason, it is his/her responsibility to convince his/her employer
that the tests need to be repeated.
June, 1992 (1) An
annual stipend of $500.00 be given to the Membership
Director
to defray the expenses that pertain to that position.
Any
further expenses (with receipts) are to be sent to the Treasurer for reimbursement
to the Membership Director.
June, 1991 (1) The
Interim examination will be given for the purpose of
retesting
only to applicants who have failed and can demonstrate a valid and imperative
reason to retake the examination.
Final approval to retake the examination will be made by the Executive
Board following a review of the request after the regular examination. Examination results must indicate that the
applicant could be prepared to retake the examination at the interim date of
the Mid-winter meeting. Retesting only
one part of the examination will be allowed.
To be qualified to take the exam, the applicant must have received a
grade of at least 85% on the other four parts of the examination. Retests will not be given on the
germination practical part of the test.
The interim examination will be given only at the Mid-winter Board
meeting of the Executive Board. Three
Board members will be present to give the
examination. A fee of $500.00 plus examiner’s expenses
are to be collected from each applicant prior to the examination date.
December, 1989 (1) No
charge will be made for an Associate Member application.
December,
1989 (2) Generic seed analysis form: Registered members intending to use the
generic
seed analysis form should try to conform to Roger Danielson’s instructions as
closely as possible, but use the SCST insignia at the bottom of the form
along with: Issued by Registered Member-SCST.
The top of form should Not state SCST, as this is not a form issued by
the Society.
December, 1989 (3) Compensation
for services for Secretary-Treasurer be increased from
$150.00
to $200.00 per month as of December, 1989.
June, 1989 (4) The
Board deems it inappropriate to sanction the seed analysis salary
survey
as requested by the Front Range Seed Analysis.
June, 1985 (1) No
RST applicant may take the exam without employment as stated in
the
constitution.

SCST shall pay the travel expenses, hotel, and meals for the
mid-winter
board and annual meeting including AOSA for the
